Question Terms of Service page

The drop down excludes the Terms of service and privacy pages available in the Xenforo footer. Could those be added?

No, as those are not page nodes in the XenForo node system. You'll need to go to admin.php?nodes/ then add a new node, making sure to choose the "Page" node type.
